PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER.

BY PLACING AN ORDER WITH US YOU CONFIRM THAT YOU HAVE READ AND AGREE TO THESE TERMS.

1. GENERAL

RIDE-ONMOWERS.CO.UK are authorised dealers of Stiga and Mountfield products.

You must be aged 18 and over to order a product from this Website and by ordering a product from us you confirm that you are over 18 years of age.

You acknowledge that your purchase of any product(s) through the Website will be subject to these terms and conditions. Please read these terms and conditions carefully before ordering any products from the Website. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions. We recommend that you print a copy of these terms and conditions for future reference.

We may change these terms and conditions and will post the modified version on this page. When you order a product from the Website, the terms and conditions in force at the time of your order will apply to the contract between you and us.

2. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

After placing an order on our Website, this does not mean that your order has been accepted.

Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an e-mail that confirms the delivery of the product (the "Shipment of Order Email"). The contract between us (the "Contract") will be formed when we send you the Shipment of Order Email.

The Contract will relate only to those products whose dispatch we have confirmed in the Shipment of Order Email. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Shipment of Order Email.

It is understood that we provide Products and Services only in quantities that correspond to the average domestic need of a private consumer. Our Company therefore reserves the right to further limit the purchase options of its customers in relation to the quantities of the Products ordered and the relative total amounts, if it considers that they are not intended to meet the needs of a private consumer. We reserve the right, at our sole discretion, to reject any orders received by notifying you in writing without incurring any further liability.

3. PURCHASE OF PRODUCTS

We accept your orders if you are resident in England, for delivery to UK mainland addresses only. We do not deliver outside of England. Please, see the “delivery” paragraph.

Payment

The price you pay is the price displayed on the Website at the time we receive your order. However, if there is a pricing error, we do not have to provide the products to you at the incorrect price.

Prices are liable to change from time to time, but changes will not affect orders in respect of which we have already confirmed.

Payment for all products shall be by bank transfer, credit card, debit card or via PayPal. Payment for all products and applicable delivery charges is taken when the order is placed. We reserve the right, at our sole discretion, to make external checks including via third parties, in order to verify your age and identity.

Delivery

We aim to deliver your order as soon as possible after full payment is received. If the products are in-stock, we aim to have them delivered within 14 days. Products out-of-stock and have to be ordered by us, may take a little longer. We only deliver within England and please contact us prior to placing your order if delivery is to be outside of this area. It is your responsibility as the customer to select the correct delivery method and we reserve the right to retrospectively charge the correct fee if the incorrect selection has been made at time of purchase.

If you are not able to accept a delivery when the day and time was agreed in advance, a further charge of up to £350 will be required for another delivery attempt.

4. CANCELLATIONS AND RETURNS

14 Days Cooling Off Period

You have a legal right to cancel your order (being a contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2014) within 14 days of delivery of the product to you. You then have 14 days from this date to return the product to us.

To cancel a Contract, you need to let us know that you have decided to cancel. You can email us at [email protected]. If you are emailing or writing to us, please include details of your order to help us identify it. If you notify us of your decision to cancel your order by email or by post, then your cancellation will be effective from the date you send the email or post the letter.

If you cancel this contract, we will reimburse all payments received from yourself, excluding the costs of delivery. We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by yourself.

We will issue the reimbursement without undue delay, and no later than:

(a)30 days after the day we receive from you any goods supplied, or

(b) (if earlier) 30 days after the day you provide evidence that you have returned the goods, or

(c) if there were no goods supplied, 30 days after the day on which we are informed regarding your decision to cancel this contract.

We will issue the reimbursement using the same means of payment as you used for the initial transaction.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. We will also inspect the item to confirm it is in unused, original condition. You shall send back the goods or hand them over to us, without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back goods before the period of 14 days has expired.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature and characteristics of the goods.

On cancellation for whatever reason, where you have received the goods you must return the goods to us (together with the original packaging) without undue delay and in any event within 14 days after the day of the cancellation at your cost. You must return goods with all components and also any promotional items received (including free gifts) or discounted additional products. You can return certain goods by post from your local Post Office and larger products by carrier pick up service.

You may also arrange transport to our warehouse at the address below. Before sending any item, it is essential to gain a returns number from us.

Faulty or Defective Products

A product received is classed as faulty if it is not;

i) Of satisfactory quality (within the meaning of the Consumer Rights Act 2015).

ii) Fit for the purpose described by us on the Website or as set out in any relevant brochure.

iii) As described - conform materially to the specification as set out on the Website or in the applicable user manual.

You may reject an order from us for a full refund or replacement within 30 days of delivery of your goods if the item does not meet the standards above.

Returned Products

Your sole remedy following the return of a defective product outside of 30 days to us shall be its repair, replacement or a refund, which shall be decided at our sole discretion.

All returned products are inspected before any refund is issued. We reserve the right to refuse a refund and to recover our costs in the event that i) you have made further use of the product after giving notice that you intend to cancel the order and return the product to us, ii) the defect in the product has arisen because you have failed to follow any instructions set out in any relevant user manual or on the manufacturers Website as to storage, use and maintenance of the product, iii) the product has been altered or repaired other than by a Mountfield authorised dealer or iv) the defect has arisen as a result of fair wear and tear, wilful damage, negligence or abnormal storage or working conditions.

The cost of the return delivery will be deducted from any refund issued in this circumstance.

5. PAYMENT AND PAYMENT SECURITY

Purchases made on the website site can be paid through: Credit Card, Debit Card (Visa, Mastercard, Maestro) or PayPal. Purchases are made with maximum security: using advanced technological systems designed specifically for electronic commerce; protecting Your personal data with encryption systems; protecting Your credit and debit card information from unauthorized access by third parties.

Upon the payment, we will receive an e-mail containing a summary of your order and the corresponding order number to check it at any time the state.

We work in partnership with PayPal to ensure all information you give us during the order process is encrypted before transmission via our Website.

6. WARRANTY

All Mountfield products carry a manufacturer’s warranty, the period of which will be dependent on the specific product, which will be identified in the product’s user manual. The warranty period starts from the date of delivery and is conditional on the product being serviced at the recommended intervals by a Mountfield authorised dealer. The warranty covers faults which may occur due to faulty components or workmanship but excludes consumable items, fair wear and tear or defects caused by misuse. This warranty is in addition to and does not affect your legal rights in relation to products that are faulty or not as described.

In the event the product proves to be faulty we shall during the warranty period, at our sole discretion, offer to either repair or replace the product. You shall have no further remedy for a faulty product.

7. PRIVACY

We will use the information You provide solely for the purposes of processing Your order or enquiry, and if you will accept for the purpose of marketing advice.

Details required as part of the payment process for security and validation checks will be passed to Paypal.

Your name, address and telephone number will be kept by us solely for the purposes of delivery of Your order and any warranty or after-sales services.

Please, see our privacy policy which sets out the terms on which we process any personal data we collect from You, or that You provide us. By using our Website, You consent to such processing and You warrant that all data provided by You is accurate.

8. INTELLECTUAL PROPERTY

We retain all rights to images, trademarks, copyright and materials contained in this Website. We are the owner or the licensee of all intellectual property rights in the Website, and in the material published on it and any user guides or other materials supplied to you in respect of an order. These works are protected by copyright, intellectual property rights and other relevant laws. All such rights are reserved. You are permitted to use material from this Website for your own personal non- commercial use only, any other use is strictly prohibited.

9. DISCLAIMER

Whilst we have made every effort to ensure that the content of this Website is correct and up to date, we do not guarantee the content will be free of errors. The images of the products on the Website are for illustrative purposes only and the colour of certain products may vary from those illustrated.

10. OUR LIABILITY TO YOU

Nothing in these terms limits or excludes our liability for:

a) Death or personal injury caused by our negligence;

b) Fraud or fraudulent misrepresentation;

c) Any breach of the terms implied by section 123 of the Sale of Goods Act 1979 (these relate to the title and quiet possession);

d) Any breach of the terms implied by section 13 to 15 of the Sale of Goods Act 1979 (these relate to the description of the product, its quality, fitness for purpose and samples);

e) Defective products under the Consumer Protection Act 1987 Subject to the above, we will under no circumstances whatever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise arising under or in connection with the contract for any loss of profit, loss of business, business interruption, loss of business opportunity or any indirect or consequential loss.

Subject to those liabilities set out at a) – e) above, our total liability to you in respect of all losses arising under or in connection with the contract whether in contract, tort (including negligence), breach of statutory duty, shall in no circumstances exceed the purchase price of the product to which the claim relates.

Nothing in this paragraph is intended to exclude or limit your legal rights as a consumer.

12. FORCE MAJEURE

We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under a Contract that is caused by events, circumstances or causes outside of our control.

If an event outside our control takes place that affects the performance of our obligations under this Contract i) we will contact you as soon as reasonably possible to notify you and ii) our obligations under the Contract will be suspended and the time for performance of our obligations will be extended for the duration of the event outside our control. Where the event outside our control affects the delivery of the products to you, we will arrange a new delivery date with you after the event outside our control is over.

You may cancel a Contract affected by an event outside our control which has continued for more than 30 days. To cancel a Contract in these circumstances, please contact us. If you opt to cancel, you will have to return (at our cost) any relevant products you have already received and we will refund the price you have paid, including any delivery charges.

13. GENERAL LEGAL TERMS

Governing Law

This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

Waiver

If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

Severability

Each of the paragraphs of these terms and conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

Warranty and After Sales Support

STIGA Ltd. provides warranty on its Mountfield products against defects in materials and workmanship. Their products have been manufactured to the highest quality standards and are guaranteed for domestic use against faulty parts or manufacture.

Warranty covers all parts and labour undertaken on your machine covered by this policy. This is conditional upon the repairs being carried out by an approved Mountfield service dealer.

On walk-behind machines and handheld products, delivery and collection of the machine is the owner’s responsibility and not covered by this policy.

Warranty Periods

The warranty period starts from the date of purchase by the consumer.

Warranty periods are those effective at the time of purchase and published in Mountfield literature and on their websites. Warranties are conditional on the product being used domestically and being serviced at the recommended intervals.

For products used commercially (i.e. for hire or by contractors, local councils, caravan sites, water authorities, or any similar use where the machine is employed for financial gain or is instrumental in being employed on properties being used for financial gain) the warranty period will be 90 days, unless otherwise stated.

Batteries and battery chargers on all products carry a 12 months warranty, except for the 24V, 48V and 80V Lithium-Ion products that carry a 2-year warranty.

Should a product be replaced under warranty, the warranty period will remain effective from the original date of purchase.

Exclusions

The Mountfield Warranty will NOT cover the following:

· Consumable items, e.g. tyres, belts and blades (unless accompanied by evidence, satisfactory to Stiga Ltd., of mechanical failure).

· Second-hand goods.

· Defects which, in the opinion of Mountfield, are in any way, or to any extent, attributed to:

o ordinary wear and tear;

o misuse / accidental damage;

o failure to carry out the handling and operating instructions set out in the Owner’s Instruction Manual;

o lack of reasonable care;

o the fitting of parts, replacements or extra components which are not supplied or approved by Mountfield;

o contaminated/stale fuel.

· Products currently stored outside of the United Kingdom.

· Periodic maintenance services instructed by the operator’s manual, or service parts replacement which would include oil, filters, batteries, brake linings, fabric grass bags, fuses and other service parts unless it can be proven that the item has evidence of faulty manufacture. These items can fail due to normal wear, or through lack of maintenance.

Product Registration

Your new purchase should be registered with Mountfield using the warranty card supplied with your machine or by creating an account in ‘MyMountfield’ and registering your new purchase online at www.mountfieldlawnmowers.co.uk/productregistration. To validate your warranty in the event of any repair, the original proof of purchase will need to be shown to the repairing dealer, unless you have registered your product in ‘MyMountfield and uploaded your proof of purchase. Without original proof of purchase, this policy will not apply.

Servicing / Mountfield 3 or 5-Year Warranty

Qualifying Mountfield lawnmowers will carry a 3-year or 5-year conditional warranty from the date of purchase when used domestically. This warranty is not transferable.

To maintain your warranty your machine must be serviced by a Mountfield authorised service centre. Your local centre can be found at www.mountfield lawnmowers.co.uk or www.servicelink.org.uk.

To maintain a 3 or 5 year warranty the machine must be serviced before the end of the 2nd year of ownership and annually thereafter. Evidence of servicing will need to be produced when making a claim. Failure to keep the machine serviced at these intervals will result in the warranty reverting to a standard 2 year period.

Please be aware that when using your machine in certain conditions it will require additional servicing or maintenance as recommended in your user manual.

These conditions include, but are not limited to:

· wet weather

· dry and dusty conditions

· high temperatures

· daily use of the machine.

Spare Parts

Please note that spare part purchases are excluded from this warranty policy. STIGA Ltd. may use its discretion, in exceptional circumstances to replace a part that is deemed faulty, subsequent to fitting by an authorised service dealer.

Disclaimer

The warranty is only applicable for defects of Mountfield Products.

No person is authorised to make any warranties, representations or promises, expressed or implied, on behalf of STIGA Ltd., or to modify the terms, conditions or limitations of this warranty policy in any way.

STIGA Ltd. will under no circumstances whatever be liable for special incidental or consequential damages if they are do to any misuse or improper use of the products.

STIGA Ltd.’s obligations under this warranty are to repair or replace any faulty products meeting the above terms. The decision between repair or replacement will be entirely at STIGA Ltd.’s discretion.

The Mountfield Warranty is provided in addition to your statutory rights.
